Selling inherited property in Sweden while living in the U.S.

An inherited Swedish home can create two separate jobs: organising the estate and preparing a sale. Before appointing an agent or signing abroad, establish which person or estate is selling and what authorises that step.

The first conversation is free for up to 30 minutes and available by phone, video, or in person. No documents are required before the call. Consultations are subject to an initial matter and conflict review. Contacting the firm does not create a lawyer-client relationship.

Start with the ownership and authority position, then organise the property, signing arrangements and sale accounting. Living in the United States does not make every transaction follow the same document route.

Is the estate selling, or have you already inherited the property?

A beneficiary expecting a home and an owner selling a home are not necessarily in the same position. Ask Simon to identify the current seller, the relevant estate parties and the evidence supporting that position. The Swedish Tax Agency distinguishes a property sale by an estate from a change of owner through inheritance. A sale price or an estate agent's draft contract should not replace that preliminary check. If there is more than one heir, record any disagreement about keeping, transferring or selling the home before the sale is treated as agreed.

A house and a cooperative apartment need different checks

For real estate, the ownership-registration route involves Lantmäteriet. A Swedish cooperative apartment, or bostadsrätt, has a different structure: the Tax Agency's guidance refers to membership of the housing association when ownership changes. Identify the asset correctly, including any joint ownership. Ask who will obtain the relevant records and deal with the association or land-registration question. Do not use an American property label as a substitute for checking what the Swedish asset actually is.

What can be organised before the legal sale route is settled?

Make a practical list of keys, insurance, ongoing bills, occupancy and the person who can visit the property. Assign responsibility for each item instead of leaving it with whichever relative happens to be closest. A market valuation can help a family discuss its options, but is not itself permission to sell. Keep the estate agent's work, Swedish legal work and local maintenance separate, with named contacts and a clear decision-maker for each.

Remote signing: agree the document before arranging certification

If you plan to sign in the United States, first ask the receiving Swedish party what document and format it requires. A power of attorney should address the agreed task rather than being copied from an unrelated transaction. Notarisation, an apostille and translation answer different questions; none should be ordered merely because the signer lives abroad. Use the Department of State's document-authentication guidance to understand the U.S. issuing route, then confirm that the proposed format will meet the Swedish recipient's requirement.

Keep the sale proceeds separate from the inheritance calculation

The sale accounting should identify the seller, the account receiving payment and the items that must be dealt with before a distribution. Discuss Swedish reporting with the appropriate adviser and U.S. reporting with a U.S.-qualified tax adviser. Selling a home and receiving an inheritance are not the same tax question. Retain the contract and settlement records; do not assume the amount arriving in an account can immediately be divided between heirs. The Tax Agency's property guidance is a starting point, not a calculation for a cross-border estate.

A useful first instruction to Simon

Explain whether the home is still in the estate, whether the family agrees on a sale, and whether an agent has already been appointed. Say which Swedish step is causing difficulty: authority, ownership, an overseas signature or distribution after the sale. Simon can assess the Swedish legal scope before requesting confidential records. You do not need to upload documents before the free first conversation. Brokerage, valuation and U.S. tax advice are separate roles, not services to assume are included in a Swedish legal engagement.

Prepare for the first conversation

  • House, real estate or cooperative apartment?
  • Who is the proposed seller?
  • Who can agree to and sign the transaction?
  • Has an estate agent been appointed?
  • Where will signatures be made?
  • Who is handling Swedish and U.S. reporting?
