Cross-border term

Lagval: choice of law in a cross-border inheritance.

Lagval means choice of law. In an inheritance file, it raises the question whether a will validly selects a country's law for the succession.

A choice-of-law clause is not simply a statement about where assets are located or who should administer them. Its availability, wording and legal effect need review under the relevant rules.

Where the term may appear

Look for wording in a will or related planning document that identifies a particular country's law. Keep the complete document and any codicils. The European e-Justice guidance describes a choice of national law within the EU succession framework; it should not be assumed that every jurisdiction or every clause produces the same result.

What to clarify with the adviser

Ask whether a clause exists, which law it identifies, which rules govern its effectiveness and how it interacts with earlier wills. These are different questions from appointing an executor, selecting a court or arranging a bank transfer. Do not copy a clause from a glossary into a live will.

Prepare for the first conversation

  • Which document contains the wording?
  • Which country's law is identified?
  • What nationality and timing information is relevant?
  • Which adviser is assessing the clause's effect?
