Swedish forced heirship and an English will: questions for executors.

An English will, a Swedish family connection and assets in Sweden can raise different legal questions. Begin with the connecting facts and the applicable-law review, rather than assuming a particular heir's entitlement.

The Swedish concept of laglott matters where Swedish succession law applies. Before calculating a protected share, an executor needs advice on which law governs the relevant question, the will and the family relationships.

Keep three questions separate

First, what does the will say and which documents form the complete testamentary record? Second, which law and authority are relevant to the succession question? Third, what must happen to administer or transfer the Swedish assets? A document intended to cover worldwide assets does not remove the need to distinguish these tasks. Agree who will assess each one before the family or executor relies on a proposed distribution.

What laglott means, conditionally

The Swedish Courts explain laglott as a descendant's protected share under Swedish inheritance law, equal to half that person's statutory inheritance share. Their guidance also describes requesting adjustment of a will. This is an explanation of the Swedish concept, not a finding that Swedish law governs an estate connected with England or Wales. Keep the legal applicability question separate from the later calculation and any procedural steps.

Prepare the residence and nationality chronology

For the adviser reviewing applicable law, organise the date of death, the deceased person's nationality or nationalities, the countries in which the person lived and the dates of any moves. The European e-Justice guidance identifies habitual residence and a possible choice of national law as relevant concepts in the EU succession framework. An England–Sweden file requires review of the rules that actually apply; this checklist is not a conclusion that both jurisdictions follow the same framework.

Read the complete will, including any law-choice wording

Identify all wills, codicils and any express choice-of-law wording. Ask the adviser to check their dates, scope and interaction rather than relying on a summary such as English will or worldwide will. The question of who is named as executor is different from the question of which succession law applies. Do not draft replacement clauses, disregard an earlier document or decide that a clause is effective from this guide.

Map family relationships before proposing figures

Prepare a clear family outline for the legal review. Record relevant relationships and dates without assuming that being named in a will is the only route by which a person may have an interest. Keep entitlement questions separate from who is entitled to receive information or act for an institution. No protected-share amount is calculated here: that requires the applicable rules, the actual family and the estate to be assessed.

Treat notices and deadlines as a separate workstream

Ask the responsible adviser whether a notice, adjustment request, challenge or other action requires attention, who must take it and which date starts any time limit. A free first call does not stop a deadline. Tax-residence correspondence should not be treated as an answer to a will or succession-law question without advice on its relevance. If time is short, identify the date and the requested legal task at the outset.

Scope the Swedish instruction for the English adviser

An England and Wales solicitor may need a focused Swedish-law analysis rather than a complete Swedish administration engagement. Define the question, documents to review, recipients of the advice and responsibility for implementation. Simon's role remains Swedish legal work from Stockholm, coordinated with appropriately qualified England and Wales advisers. Fees and scope are confirmed after the matter has been reviewed; this guide promises no outcome or completion date.
