Guide

Swedish shares in an English estate: a checklist for executors.

A Swedish shareholding can raise several questions at once: who holds the securities, who may obtain information, and who may instruct a sale or transfer. Deal with those questions separately before sending a general probate bundle.

The first conversation is free for up to 30 minutes and available by phone, video, or in person. No documents are required before the call. Consultations are subject to an initial matter and conflict review. Contacting the firm does not create a lawyer-client relationship.

This guide focuses on organising a Swedish securities instruction for an estate administered in England and Wales. It does not give investment advice, value a holding or decide which country's succession law applies.

Identify the holding before choosing the recipient

Start with the records already available to the executor. Is there a Swedish bank account, a securities account, a fund holding or shares in a private company? Record the institution or company named in the documents and the contact handling the deceased-estate enquiry. Do not assume that every Swedish investment is dealt with by the same bank or uses the same transfer procedure. A statement showing a balance does not necessarily explain who can obtain further information or give instructions.

Separate information, valuation, sale and transfer

Write down the immediate task. Asking for a date-of-death statement, requesting a valuation, selling an investment and transferring securities to a beneficiary are distinct instructions. Ask the recipient for requirements for that specific task. If it sends a standard checklist, identify which items establish identity, which establish authority and which concern the destination account or transaction. Keep the request in the institution's own wording so that Simon can review the Swedish question without guessing what it intended.

Place the English grant in the document map

GOV.UK describes probate within the England and Wales administration process. An English grant is important context, but the Swedish receiving institution should confirm what it needs for the proposed instruction. List the grant, the will and any Swedish estate documents separately. If the institution requests a translation, certified copy or legalisation, confirm the required format before ordering it. Document authentication is not the same thing as a determination of succession rights or authority to make every transaction.

Clarify whose instruction is being carried out

Identify the executor, the instructing solicitor, any Swedish estate parties and the beneficiary who may receive the asset or proceeds. Those roles should not be collapsed into one label. Ask the advisers to explain who may authorise the particular Swedish step and whether any outstanding question prevents it. If a will or family dispute is relevant, separate that legal issue from the securities administration task. Do not ask a bank's operational reply to stand in for an applicable-law analysis.

Agree the accounting handover

Before a sale or transfer, agree who needs the resulting records and what the receiving adviser will use them for. Maintain a record of the instruction, transaction statement and any fees identified by the institution. The England and Wales adviser should confirm its own probate, accounting and tax requirements; Swedish reporting questions need the appropriate advice as well. Simon's Swedish legal engagement is not an investment recommendation. Avoid giving trading instructions until the authorised decision-maker and document route are clear.

What should the solicitor ask Simon to deliver?

A focused instruction might be a review of the Swedish institution's requirements, a document-function checklist or a defined Swedish administration task. State which answer is needed and whether there is a deadline imposed by an institution or proceeding. Explain who the client is and who is instructing each professional. Begin with a non-confidential outline at the free first call. The secure exchange of statements, identity records and originals can be agreed after matter fit, conflicts and scope have been considered.

Prepare for the first conversation

  • Type of investment and named custodian or company
  • Information, valuation, sale or transfer?
  • The recipient's exact written requirement
  • Existing English and Swedish records
  • Who may authorise the instruction?
  • Who needs the transaction and accounting records?
